RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS, AND INDEMNITY AGREEMENT

I, The “Renter” (Hereinafter referred to as Renter), on behalf of myself and all members of my party, hereby acknowledge that I am renting camping equipment from “Campable Inc.” (Hereinafter referred to as Campable Inc.) for our own personal use. I confirm that I am at least 18 years old and I understand that the use of camping equipment involves inherent risks and dangers, including but not limited to, the risk of serious bodily injury, death, or property damage.

I acknowledge that I am fully aware of the risks and hazards associated with the rental and use of the camping equipment and that I am assuming these risks voluntarily. I understand that the rental of the camping equipment and any related activities, may involve certain risks and hazards.

In consideration of the rental of the camping equipment, I hereby assume all risks and release Campable Inc., its officers, directors, employees, agents, successors, and assigns from any and all liability for any injuries, damages, or losses arising out of our use of the equipment, including but not limited to, those caused by the negligence of Campable Inc., its officers, directors, employees, agents, successors, and assigns.

I further agree to indemnify and hold harmless Campable Inc., its officers, directors, employees, agents, successors, and assigns from any and all claims, demands, actions, suits, or proceedings of any kind or nature, including reasonable attorney's fees, arising out of or in connection with our use of the camping equipment.

I acknowledge that Campable Inc. has not made any representations or warranties about the safety of the equipment or the suitability of the equipment for any particular purpose, and that we have rented the equipment solely on the basis of our own judgment and evaluation.

I understand that this Release of Liability, Waiver of Claims, Assumption of Risks, and Indemnity Agreement applies to all activities related to the use of the camping equipment, whether occurring on or off the rental premises, and that all members of my party are bound by the same terms and conditions.

I acknowledge I am responsible for any lost, damaged, or stolen equipment, and agree to pay Campable Inc. an amount specified in writing by Campable Inc. for such equipment. At the time of damage, loss, or theft, Campable Inc. will specify what amount I am required to repay. The Renter shall be responsible for any loss or damage to the equipment, regardless of fault or negligence. Normal wear of items is acceptable and is determined at the discretion of Campable Inc., or one of its officers, directors, or employees.

I acknowledge that if my package is not returned within the specified time on my booking, Campable Inc. reserves the right to charge an additional day of rental fees for every day the package is late. These fees can be collected in addition to any fees related to damage, loss or theft. 

If any provision of this Release of Liability, Waiver of Claims, Assumption of Risks, and Indemnity Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes closest to the intention underlying the invalid or unenforceable provision.

Any litigation involving the parties to this Agreement shall be brought solely within the Province of Manitoba, Canada and shall be within the exclusive jurisdiction of the Courts of Manitoba, Canada.

I acknowledge that I have read this Release of Liability, Waiver of Claims, Assumption of Risks, and Indemnity Agreement, understand its contents, and voluntarily agree to its terms and conditions.
